• The Iron Pony Riding Academy requires all students to have a valid temporary permit or motorcycle endorsement to take a class.
    We will not offer refunds, transfers, or exchanges for those who enroll in a class but do not have a valid Ohio TIPIC.
    • Terms and Agreements

    • By submitting your credit card via the registration page of Iron Pony Riding Academy, you, the registrant (hereinafter referred to as "you" or "your") will be deemed to have read and agreed to the following Terms and Agreements, in addition to any terms and conditions of the applicable credit card processing company retained by us for processing your credit card. These Terms and Agreements constitute a binding agreement between you and Iron Pony Riding Academy as hereinafter defined and set forth in the Terms and Agreements. Accordingly, you should thoroughly read and understand the following Terms and Agreements, which will become a contract between you and Iron Pony Riding Academy upon submitting your personal and payment information to Iron Pony Riding Academy for class registration.
    • 1. Class Registration.

    • Your class registration will be confirmed when your payment has been received by Iron Pony Riding Academy. Your registration is non-transferable. It is yours and yours alone.
    • 2. Refund and Rescheduling.

    • A. Refund Policy: Refunds are not given once your registration is submitted. There are no refunds on deposits.
    • B. Rescheduling by Participant: Rescheduling by Participant is prohibited.
    • 3. Class Requirements.

    • A. Permit: To participate in the Basic Rider System (“BRS”) you must present Iron Pony Riding Academy with a valid Temporary Instruction Permit Identification Card (“TIPIC”). You understand and agree that, unless your TIPIC is provided to Iron Pony Riding Academy at the required time, you will not be allowed to participate in the registered-for course and will have forfeited your course fee.
    • B. Attendance: You must attend all course sessions in their entirety with no exceptions. If you do not attend any portion of your course session in a punctual manner once the course session begins, including being tardy, you will forfeit the entire course fee. No refunds or make-up classes will be offered to you due to your failure to meet attendance requirements. Please allow additional time to get to class each day as well as additional time in your course scheduling due to the possibility of the presence of inclement weather conditions as well as extended learning time.
    • C. Riding Gear: For any course, you will be presented the option of borrowing an open face or full-faced DOT-approved helmet as well as a training motorcycle if you do not have one of your own. Iron Pony Riding Academy encourages students to use their own helmets, as long as the helmet is DOT-approved and has a sticker certifying the DOT approval. You will need to wear clothing that protects you while you’re riding, including: (1) over-the-ankle boots, with good grips on the soles (heel should not exceed 1.5"); (2) long pants with no holes or tears in them (preferably jeans); (3) full-fingered gloves (preferably leather); (4) long-sleeved shirt or jacket; and (5) eye protection if wearing an open face helmet (sunglasses are fine). Full-face helmets with a closed face shield do not require additional eye protection. Make sure that you have or are wearing all of the required items during both days of being on the class riding range (not required during classroom training). Unfortunately, you will not ride without them! That would mean that you will forfeit your course fee (see section B above about Attendance). Please make sure that you have and bring all necessary items. Additionally, Iron Pony Riding Academy strongly encourages you to bring a rain coat or poncho in the event that inclement weather should occur.
    • D. Safety: Safety is our primary concern. At the sole discretion and judgment of the course instructor(s), you may be refused the opportunity to attend the registered-for course or the ability to complete the course due to a multitude of circumstances, including but not limited to (1) your failure to bring a valid Temporary Instruction Permit Identification Card (“TIPIC”), and appropriate riding gear, (2) your inability to achieve the objectives of the range exercises within the allotted time, (3) your inability to achieve the objectives of the course, and/or (4) your inability to abide by the safety instructions and course guidelines explained to you by the course instructor(s). In the event that the course instructor(s) conclude(s) that you are unable to attend or complete the course, you will forfeit the entire course fee.
    • E. Completion of the BRS: Once you have successfully completed the BRS as determined by the instructor, you will receive a completion card from Iron Pony Riding Academy, which may help you reduce the cost of motorcycle insurance. THE COMPLETION CARD IS NOT YOUR LICENSE; YOU ARE STILL A PERMIT HOLDER AT THIS POINT. For those 18 years and older, your BRS completion card acts as a waiver for the Ohio Bureau of Motor Vehicles skills test. Simply take your BRS completion card to the Ohio Bureau of Motor Vehicles facility to have the ‘M’ classification (for “Motorcycle”) added to your current driver’s license. For those 15 and ½ years of age through 17 years of age, to get an ‘M’ classification (for “Motorcycle”) added to your current driver’s license, you must successfully complete the BRS and pass the Ohio Bureau of Motor Vehicles skills test.
    • 4. Release, Waiver and Indemnification.

    • The undersigned participant, or if under the age of 18 the parent or legal guardian of the participant, does hereby execute this release, waiver and indemnification for him/herself and his/her heirs, successors, representatives and assigns; and hereby agrees and represents as follows: To release Iron Pony Riding Academy, any of its affiliates and all of their landlords, landowners, members, employees, agents, representatives and those governmental agencies and other organizations affiliated with this course including but not limited to the Ohio Bureau of Motor Vehicles and the Motorcycle Safety Foundation, their members, employees, agents, representatives, and hold them harmless from any liability, loss, damage, cost, claim, judgment or settlement which may be brought or entered against them as a result of the undersigned's participation in said course. This indemnification shall include attorney's fees incurred in defending against any claim or judgment and incurred in negotiating any settlement. The undersigned participant also fully understands there are risks involved in learning the proper skills necessary to operate a motorcycle and accepts those risks. YOU HAVE CAREFULLY READ THIS RELEASE AND UNDERSTAND ITS CONTENTS, AND BY CLICKING BELOW ON THE BUTTON MARKED "I AGREE", YOU ARE VOLUNTARILY AGREEING TO ACCEPT THE TERMS OF THIS RELEASE AND WAIVER OF INDEMNIFICATION AS YOUR OWN FREE ACT.
    • 5. Miscellaneous.

    • A. Entire Agreement: All understandings and agreements heretofore made between the parties are superseded by and merged into this Agreement, which alone fully and completely expresses the agreement between the parties, and the same is entered into with no party relying upon any statement or representation made by any party not embodied in this Agreement.
    • B. Choice of Law, Venue, and Jurisdiction: This Agreement shall be controlled, construed and in all respects governed by the laws of the United States and the State of Ohio, as if made and performed entirely within the State of Ohio without regard to any conflicts of laws principles. In the event of a dispute under this Agreement, you hereby consent to suit in the Circuit Court of Franklin County, in the State of Ohio.
    • C. Enforcement of Provisions: Whenever possible, each provision hereof shall be construed so as to be interpreted in such manner as to be effective and valid under applicable law. If any provision of this Agreement or the application thereof to any party or circumstances shall be prohibited by or invalid under applicable law, such provision shall be ineffective to the extent of such prohibition without invalidating the remainder of such provision or any other provision of this Agreement or the application of such provision to other parties or circumstances.
    • 1. Affirmation of Agreement. By clicking where indicated below on the button, you hereby acknowledge and affirm that you have read this document titled Terms and Agreements in its entirety and that you understand and agree to all its terms and conditions, including but not limited to the authorization of the use of your credit card for payment of charges and fees for the registration in one of the courses offered by Iron Pony Riding Academy.
    • READ CAREFULLY: THIS SECTION IS A LEGAL RELEASE, ASSUMPTION OF RISK, WAIVER AND COVENANT NOT TO SUE AGREEMENT

    • In consideration of Iron Pony Riding Academy, including their members, employees, officers and / or agents (the “Safety Course Providers”), furnishing services, equipment, and / or curriculum to enable me to participate in the Motorcycle Safety Course, I agree as follows:

    • I fully understand and acknowledge that: (a) there are DANGERS AND RISK OF INJURY, DAMAGE, OR DEATH that exist in my use of motorcycles and motorcycle equipment and my participation in the Motorcycle Safety Course activities; (b) my participation in such activities and / or use of such equipment may result in injury or illness including, but not limited to, BODILY INJURY, DISEASE, STRAINS, FRACTURES, PARTIAL AND / OR TOTAL PARALYSIS, OTHER AILMENTS THAT COULD CAUSE SERIOUS DISABILITY, OR DEATH; (c) these risks and dangers may be caused by my negligence; the negligence of the Safety Course Providers; the negligence of others, including other Safety Course participants; and may arise from foreseeable or unforeseeable causes; and (d) by participating in these activities and / or using the equipment, I, on behalf of myself, my personal representatives and my heirs, hereby assume all risks and all responsibility, and agree to release the Safety Course Providers for any injuries, losses and / or damages, including those caused solely or in part by the negligence of the Safety Course Providers, or any other person including myself, as well as any costs, judgments or settlements which may be brought or entered against them as a result of my participation in these activities and / or using the equipment. If I have brought a motorcycle to use in the Safety Course, I also agree that this release applies to any damage that occurs to it during the Safety Course.

    • I agree and understand that, on behalf of myself, my personal representatives and my heirs, I am relinquishing any and all rights I now have or may have in the future to sue the Safety Course Providers for any and all injury, damage, or death I may suffer arising from motorcycle riding or its equipment, including claims based on my negligence, others’ negligence, or the Safety Course Providers’ negligence.

    • I HAVE READ THIS RELEASE AGREEMENT AND BY SIGNING BELOW I AGREE IT IS MY INTENTION TO ASSUME ALL RISKS AND RELEASE SAFETY COURSE PROVIDERS FROM LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE OR WRONGFUL DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.
    • I have had the opportunity to ask any questions about the above waiver and release and I understand its terms and meaning.

    • The release and waiver form must be signed prior to the beginning of the course. If you are 15½ - 17 years old, this form must either be signed in the presence of the course instructor by a parent or legal guardian or must be notarized.

    • READ CAREFULLY: THIS SECTION IS AN INDEMNIFICATION AND HOLD HARMLESS AGREEMENT

    • In consideration of Iron Pony Riding Academy, including their members, employees, officers and / or agents (the “Safety Course Providers”), furnishing services, equipment, and / or curriculum to enable me to participate in the Motorcycle Safety Course, I agree as follows:

    • I, on behalf of myself, my personal representatives and my heirs, agree to hold harmless, defend, and indemnify the Safety Course Providers from any and all claims, suits, or causes of action by others for bodily injury, property damage, or other damages which may arise out of my use of motorcycles and motorcycle equipment or my participation in the Motorcycle Safety Course activities, including claims arising from the Safety Course Providers’ or any other party’s negligence.

    • I HAVE READ THIS INDEMNIFICATION AND HOLD HARMLESS AGREEMENT AND BY SIGNING I AGREE IT IS MY INTENTION TO ACCEPT LEGAL RESPONSIBILITY AND PAY FOR ANY LOSS FOR CLAIMS OR LAWSUITS AGAINST SAFETY COURSE PROVIDERS ARISING FROM MY PARTICIPATION IN THE MOTORCYCLE SAFETY COURSE.
